In part: "...some account of the death of Dempsey Hays, who was shot some ten days since ... Hays was arrested by a constable with a posse of 7 men including Hardin [the defendant in a suit Hays had initiated] & some of his well known followers. He was arrested at a neighbor's house & went off with the company to show them where the principals in the alleged theft were concealed. Shortly afterwards two or three guns were heard & after a while the company returned & reported that Hays had jerked a gun from one of the crowd and fired at them & upon that they had shot him."
